Company ordered to re-hire employees fired for moaning about their jobs on Facebook

This case outlines an example thought to be the first of its kind.  An NLRB judge has ruled that 5 employees of a non-profit company, whom were fired for complaining about their employer on Facebook, were ordered to be reinstated.

As the article states, "Judge Amchan ruled the employees were protected because theirs was a conversation among co-workers about the terms and conditions of employment, and that their conduct did not forfeit their protection under the law.
He ordered the nonprofit to reinstate the five employees and issue back pay because they were fired illegally. He further ordered Hispanics United to post a notice in Buffalo about employee rights under the Act."

The employers had posted comments about other co-workers statements that their organization wasn't doing enough to help customers.  The employees complained about working conditions and defended their own performance on Facebook, blaming the employer for their inability to better assist customers.
