How to Exclude an Expert Who Says There is No Expectation of Privacy

This article discusses a disqualification of a defense expert whom was going to testify that there is no expectation of privacy for computer use.  There were several reasons the expert's testimony was not permitted, one of which is that the court found that the expectation of privacy is a matter of law.  In addition, the court also held that the experts opinion was contrary to case law.
