New York Courts Grapple With Social Media Mining

This article discusses two recent New York State cases that looked at the issue of whether social media network data is subject to civil litigation discovery requests.  The article references two cases, Abrams v. Pecile, 83 A.D.3d 527 (1st Dep’t 2011) and Patterson v. Turner Construction Company, 2011 WL 5083155 (1st Dep’t 2011).

The article states that if relevant evidence may exist in social media networks, than it is discoverable. As the author writes, "the online world of social media, despite being a relatively new and rapidly changing phenomenon, is simply an extension of the offline world and evidence created online should be treated no differently than that created by traditional means."
